Who does the Building and Construction Code apply to?

The following bodies are expected to comply with the standards of practice set out in the Code:

  • employers and industry associations
  • unions
  • contractors
  • sub-contractors
  • consultants
  • suppliers

These bodies are expected to:

  • adopt a co-operative approach to industrial relations
  • communicate honestly and openly with other industry participants
  • demonstrate a commitment to a best practice working environment
  • provide equality of opportunity to all employees and applicants for employment

What does the Code cover?

The Building and Construction Code sets out the requirements expected to be met by organisations operating within the building and construction industry in Victoria. Areas such as awards and legal obligations, membership of industrial organisations, workplace arrangements and project agreements are all considered within the Code.

Awards and legal obligations

All parties involved in building and construction projects in Victoria must comply with, where applicable:

  • federal awards and registered enterprise bargaining agreements
  • industrial agreements made between unions and employer organisations
  • legislative requirements

Any arrangements or work practices intended to avoid the above requirements are not permitted.

Membership of industrial associations and dispute settlement

Participation in industrial relations by employees and employers is encouraged as is responsible representation by industrial associations.

All parties are required to make every effort to resolve grievances or disputes at the enterprise level, by following the procedures outlined in the relevant awards and workplace arrangements. During the resolution procedure the current conditions will prevail. Work must continue normally while relevant procedures are taking place.

If unsafe conditions exist, work must continue in all areas away from the unsafe area, and the employer must act promptly to re-establish workplace safety. All parties must co-operate to see that the re-establishment of safety takes place immediately. Work must recommence immediately once workplace safety has been re-established.

During periods in which employees are engaged in industrial action, they will not be paid, unless payment has been authorised by awards, industrial agreements or legislation.

If there are any industrial relations/occupational health and safety issues that may have an impact on the construction program, the contract, project costs or other related contracts, the principal, client or head contractor must be informed about them at the earliest opportunity. Effective and regular reporting processes should be established to facilitate this.

Compliance with the Code

Compliance with and breaches in relation to industrial relations principles are considered in sections 7.1 and 7.2 of the Victorian Code of Practice for the Building Industry, which are included as appendices in the Code.

The Code of Practice for the Building and Construction Industry (and its accompanying revised industrial relations principles) provides a benchmark for the building and construction industry and describes the minimum standards of acceptable practice for parties involved in construction projects funded by the Victorian Government.

Revised principles of the Code

Revised industrial relations principles were included in the Code in January 2002 and should be read in conjunction with the Code. These replace references to industrial relations elements in Section 2 of the Code.
